Dear MS.(sic) Harris:

Here are the coupons you sent us in response to your (6 page) “full investigation” into the matters which transpired and of which I informed MS. (sic) Robinson, during our shopping purchase at the Safeway in Pinole on the evening of October 13th, ’99. Do not send us anything more - Safeway’s manner and content of response serves only to add insult to injury.

Safeway has responded to the facts of our Pinole Safeway shopping excursion of October 13th in precisely the manner I had anticipated and verbally predicted to Ann Robinson of Safeway’s claims department. You have thrown the facts of your employee's abhorrent customer service into eclipse and tossed Matt’s and my sincere and witnessed verbal reports, regarding that evening’s store manager’s outward display of sexual orientation discrimination, onto the bonfire (as if our related statements were to you garbage ripe for incineration). Safeway has outright denied the store manager’s closing remark to us in which he quietly, but audibly uttered to us his anti-gay epithet. You have further suggested the following: regarding General Mills-Betty Crocker Sour Cream & Chives Mashed Potatoes package, which in your letter to us you openly state that the General Mills Product-in-question came from the Appian Way Safeway-Not withstanding the obtaining facts you somehow conclude that Safeway is absolved from all responsibility concerning the Betty Crocker package now in our possession, which was tampered with and sold in an illegal condition.

Safeway’s written response to this incident is nothing less than legal weasel tactics whose entire purpose is escape from any responsibility relating to the facts of our October 13th Safeway shopping excursion with claims of “Safeway’s superior service,” claiming further on in the same letter that the product-in-question arrived from General Mills in its current condition. In so responding Safeway has erroneously and simultaneously circumvented the perhaps unanticipated, currently factual procedures already under way which have begun to move in the following fashion:

The General Mils (sic) product in question is scheduled to be analyzed by one of the Nation’s leading and most highly respected laboratories. General Mills will be properly advised of the time and place of analysis of the product-n (sic) in-question, and may possibly be invited to be present during the time in which the laboratory experts conduct product analysis. Said laboratory experts, c9onversant (sic) with the scientific condition and consequences of the lab’s forthcoming written analysis will also serve as expert witnesses to the legal courts and make available to the press and media their lab’s findings.

This written lab report will also be featured for public view on my web site, www.starbucked.com. This lab report will be assimilated into my entire 'Year 2,000' web site redesign which will include a "Safewayed Top Ten," listing corporate entities that have publicly demonstrated in a repeated and conspicuous fashion a disregard for customer service, poor product handling or sale, inferior company service and management improprieties and or any other relevant corporate misdoings or offenses which the public has a constituional right to be informed of.

There will be at some future point legal proceedings brought against Safeway and General Mills y any and all parties, individually or on a class action basis that relate to the above mentioned violations and or any other othtstanding violations which may be valid and known at that time.

Per the obtaining violations as above stated, with respect to Safeway, proper communication of these offenses willl be shared with gay rights groups, the ACLU, the U.S. Department of Justice, The Food and Drug Administration and any other relevant bodies of authority, who may so elect and participate, along with local and national press, in divulging full knowledge of the facts of this case to the public as well as any other valid and relevant cases, in an honest, rightful and just manner with an eye on bringing some eventual outcome of publicly legal and ethial justice to the forthcoming claims against Safeway and General Mills. It is hoped that Safeway and General Mills will be held publicly and legally liable for any and all criminal, legal and civil violations pertaining to this case and any valid case brought heretofore by the public.
